Roger McCabe presently focuses his practice on family law and the mediation of family law disputes. He has tried several contested child custody issues for his clients. When not representing his own clients, Mr. McCabe serves others in the mediation of family law matters. He is a certified Mediator and also a Certified Parenting Facilitator. In 2016, Mr. McCabe was honored as Mediator of the Year by the Jefferson County Dispute Resolution Center.

In addition to family law, Mr. McCabe’s practice areas include personal injury, products liability, and business disputes. He represents plaintiffs, defendants, petitioners or respondents. As lead counsel, he has tried more than 100 civil cases to a jury verdict.

Following four years on active duty as an officer in the United States Navy JAG Corps, Mr. McCabe joined MehaffyWeber in 1973. He is a shareholder in the firm.

Mr. McCabe graduated from Marquette University with a Bachelor Science, cum laude, and obtained his law degree from the University of Iowa with a Juris Doctorate, cum laude. He has been Board Certified by the Texas State Board of Legal Specialization in Personal Injury Trial Law (1978-2015) and the Texas State Board of Legal Specialization in Family Law (1980). He is a member of the American Board of Trial Advocates (ABOTA) and a Fellow of the Texas Bar Foundation. He is an active Rotarian, having served as the Beaumont Club’s President in 2001-2002 and Rotary District 5910 Governor in 2008-2009.

City of Baytown v. Senterra Development
Roger McCabe, Commercial Litigation

Roger McCabe with Co-Counsel, Richard Peebles, represented the City of Baytown against Senterra Development, Wilson Architectural Group, and Turner Construction Company of Texas for breach of contract. The companies were hired to develop a marina, convention center and hotel at Bayland Island. The buildings had numerous leaks and did not meet building codes for withstanding wind. The case was successfully settled for $1.2 million.

In the Interest of Kadence LeMaire – Family Law

Roger McCabe represented Vickie Stewart and her husband Sam before a jury seeking to have them named Sole Managing Conservators of Vickie’s grand-niece Kadence. Kadence’s was born to a single mother who died shortly after birth. Kadence had been in the possession of other family members until the time of trial. The jury awarded Sole Managing Conservator to the Stewarts who subsequently adopted Kadence. In the Matter of the Marriage of Michelle Lee Swales and Gregory Lee Swales, Jr. and in the Interest of Madison Leanne Swales, Abigail Greer Swales and Gregory Lee Swales, III, Children – Family Law

Roger McCabe represented Michelle Lee Swales, mother of the three children, before a jury in a Motion to Modify an Order setting aside the geographic restriction restricting her residence to Jefferson County, Texas and permitting her to move with the children to Mississippi. The jury found in favor of setting aside the geographic restrictions and permitting Michelle to move to Simpson County, Mississippi with the children.
