Brad K. Howell is a trial lawyer with extensive experience in the areas of products liability, catastrophic personal injury, statutory indemnity, toxic tort, and commercial litigation. Mr. Howell has handled litigation in state and federal courts throughout Texas, Oklahoma, Louisiana, Arkansas, New Mexico, Colorado, Utah, Montana, Florida, West Virginia, and New Jersey.

Mr. Howell has dedicated his career to litigation. During his last year in law school, he was selected to chair the South Texas College of Law Board of Advocates, which facilitates the school’s advocacy training and trial competitions. To date, his law school has won more than twice as many national advocacy competitions as any other law school in the country. After graduating from law school in 1999, Mr. Howell joined an established trial firm in downtown Houston. Only weeks after earning his law license, Mr. Howell took his first case to trial and won a favorable verdict for his client.

Not even a full year into his practice, he joined a distinguished trial practice, which afforded him an opportunity to further sharpen his skills. During that year, he was on a team that tried high-stakes, personal injury cases in Kansas, Colorado, and Texas. One case involved a demand for $130 million; however, after a three-week trial and a full day of deliberations, the jury returned a verdict in favor of Mr. Howell’s client — a Fortune 50 multinational corporation.

Mr. Howell continued winning many more victories in the courtroom before he was hired as a partner at one of the largest law firms in the country. Within weeks of joining that firm, he was back in the courtroom, trying a catastrophic injury products liability lawsuit. After a two-week trial, the jury returned a unanimous verdict in favor of his client. Over the eight years that followed, he served as trial counsel for one of the world’s largest heavy equipment manufacturers, among other large national and international clients. At MehaffyWeber, Mr. Howell continues to deliver big wins for clients and has gained a reputation for his depth of knowledge and courtroom experience.

Brad Howell was the first-chair trial counsel in a lawsuit involving catastrophic personal injury. He successfully defended a heavy equipment manufacturer and its dealer against theories of strict products liability and negligence. Additionally, Mr. Howell assisted in drafting the appellate brief and gave an oral argument at the Second Court of Appeals of Texas. The judgment was unanimously affirmed on appeal.

Brad Howell represented an international manufacturer and domestic seller in a wrongful death and products liability action. After a lengthy trial, the jury unanimously found in favor of Mr. Howell’s clients.

Brad Howell defended a heavy equipment manufacturer in a wrongful death, multiparty lawsuit. He obtained a summary judgment on multiple theories of liability, including design defect, failure to warn, failure to test and breach of implied warranty.  Following final disposition of the underlying case, a component part manufacturer filed a companion case against the manufacturer, seeking statutory indemnity. Mr. Howell won a second summary judgment for the manufacturer on statutory cause of action.

 

Toxic Tort Defense

Brad Howell successfully defended a heavy equipment manufacturer and dealer in dozens of toxic and mass tort cases filed by more than 1,000 plaintiffs in state courts throughout East Texas. He won summary judgment and secured nonsuits of hundreds of claims involving personal injuries allegedly caused by exposure to asbestos, solvents, silica, diesel fumes and welding fumes.

Brad Howell won summary judgments and secured nonsuits of more than 100 claims involving personal injuries allegedly caused by repetitive trauma during the operation of various pieces of heavy earthmoving equipment.

Brad Howell served as second-chair in a trial counsel for an environmental consulting firm involved in a case alleging misappropriation of trade secrets and tortious interference with contractual relations. The jury returned a $3 million verdict in favor of the client, including an award of exemplary damages. Additionally, Mr. Howell helped draft the appellate brief and prepare for oral arguments at the Fifth Circuit Court of Appeals. The judgment was unanimously affirmed on appeal.
