Antelope Oil Tool and Manufacturing – Complex Commercial Case

Forum brought a complex commercial case alleging breach of a non-compete agreement, misappropriation of trade secrets, breach of fiduciary duty and breach of confidentiality agreements as well as aiding and abetting such actions. MehaffyWeber represented Antelope, a defendant, and another company, Wearsox, LP (which was alleged to be a co-conspirator). Antelope was alleged to have hired Musselwhite and Romero, encouraged them to breach their agreements with Forum and misappropriate Forum’s trade secrets. Forum sought up to $25,000,000 in damages from Antelope during the trial but asked the jury for $9,000,000 in actual and punitive damages during trial. Prior to trial, the Court invalidated as a matter of law the non-compete agreement. After a nearly six week trial, the jury returned a verdict in favor of the defendants finding that there were no breach of confidentiality, no breach of fiduciary duty violation of trade secrets. The jury also made a determination which allowed recovery of attorney’s fees.

Fielding v. Tullos

MehaffyWeber’s client, Mrs. Tullos, was a long-time friend and caregiver of Mr. Hodge, who was a widower and had no children. He designated her as the beneficiary of his retirement accounts. His niece sued her for undue influence and breach of fiduciary duty. MehaffyWeber motioned a Summary Judgment for our client and upheld that judgment on appeal.

Gold Pass LNG Terminal – Employment Case

MehaffyWeber represents Golden Pass LNG Terminal in a constructive discharge employment case. The plaintiff claims race and age discrimination. Our client strongly opposes such claims and multiple legal motions are pending in federal court. The case will be tried to a jury if not decided by motion prior to trial. The case is significant because the concept of constructive discharge should be a matter of law if the legal challenge is not granted in our client’s favor, the case will be tried. A negative result could impact employee relations for the entire company and possibly encourage other litigation. MehaffyWeber obtained summary judgment on the employment claims and a dismissal of the personal injury claims.
